Separation and divorce often cause financial hardship and questions surrounding fair compensation and earnings potential for each partner. Spousal Support Advisory Guidelines (SSAGs) help judges decide how much spousal support should be paid, and for what length of time. Nevertheless, SSAGs are only guidelines, and not laws.

A judge can order more or less support than what these guidelines recommend. In recent years, there have been numerous cases where judges have exercised their power to impute income thus substantially amending the amount of spousal support granted by the Courts. This is especially true in circumstances where there is clear, irrefutable evidence indicating that an ex-spouse is not maximizing their earnings potential. Our team of professionals, assess and consider a number of factors including an individual’s background, experience, education, and prospects in the current labour market, to provide an objective, evidence-based expert opinion on that partner’s earnings potential.
