An independent Earnings Capacity Assessment in Toronto establishes one’s current or future earnings capacity to assist in the determination of fair compensatory or non-compensatory support entitlement. During this assessment a number of factors are considered and their impact evaluated which typically include an individual’s background, experience, education, and prospects in the current labour market, to provide an objective, evidence-based expert opinion on that person’s earnings potential. This assessment is often conducted in conjunction with a Transferable Skills Analysis and a Labour Market Survey and assists lawyers in determining financial entitlement or responsibility for their clients during divorce proceedings. It can be completed in-person or as a file review if the spouse is not available.
